PUBLIC HEARING NOTICE – Ordinance & Resolution

Notice is hereby given that the Board of Burleigh County Commissioners will conduct a public hearing during their scheduled meeting on Monday, March 16, 2026, at 5:00 pm local time in the Tom Baker Meeting Room, City/County Building, 221 North 5th Street, Bismarck, ND. The Board of Burleigh County Commissioners will at this time hear all interested people regarding the following:

Amend or re-enact Ordinance 23-01 as it regards operation of off-highway vehicles within the public right of ways.

Adopt Resolution 2026-001 – Moratorium on the use and operation of Off-Highway Vehicles

If you are not able to attend the public hearing, you may submit your comments in writing to Burleigh County Building, Auditor, PO Box 5518, Bismarck, ND 58506-5518, or email at burleighauditor@nd.gov. Letters and comments must be received by 8:00 am on March 16th so they may be distributed to the Commissioners before the meeting. Letters and comments received after 8:00 am, March 16th will be distributed at the meeting.

PUBLIC NOTICE – Approved Zoning Ordinance Amendment

Notice is hereby given that the Board of Burleigh County Commissioners at their February 2, 2026, meeting approved an ordinance amending the 1972 Amended Zoning Ordinance of Burleigh County:

Article 21 FP-Floodplain District of the Zoning Ordinance is hereby amended to include the following:

The legislature of the State of North Dakota has in North Dakota Century Code, Chapters 20-05, 11-11, and 58-06, delegated responsibility to local governmental units to adopt regulations designed to promote the public health, safety and general welfare of its citizenry.

This ordinance shall be in full force and effect thirty (30) days after first publication of
this notice unless a petition for a separate hearing is filed pursuant to NDCC Section
11-33-10.

This ordinance is available for review during normal office hours in the Burleigh County Building, Planning and Zoning Department, 221 N. 5th Street, Bismarck, ND

Noxious Weeds & Hay Cutting in Ditches

In accordance with NDCC 4.1-47-02, it shall be the duty of every person (individual, partnership, firm, corporation, company, society, association, the state or any department, agency or subdivision thereof, or any other entity) to eradicate or control the spread of noxious weeds on lands owned or controlled by him/her in the state of North Dakota. Control means to prevent the spread of any noxious weed by seed or any other propagating part. Such parts must not be transported in any manner. Penalties are provided for in NDCC 4.1-47-31.

The Burleigh County Noxious Weed Control Board will spray portions of the road ditches with herbicides for noxious weed control. Some of the herbicides used may have a haying or grazing restriction, meaning a certain amount of time must pass after herbicide application and before haying or grazing operations may begin. These restrictions are determined by the herbicide label.

Operators who wish to cut and make ditch hay, should contact the Weed Control Officer to determine if and when a specific area has been treated and what the restriction timeline is. Operators wishing to not have their ditches sprayed prior to haying should also contact the Weed Control Office at 8100 43rd Avenue NE, Bismarck, ND 58503, phone 701-934-0088 or 701-204-7748.

NOTICE: Cost share monies are available. Contact the Burleigh County Weed Officer to sign up.
